Our DA Services

Comprehensive Development Application Services

The full suite of services for Development Applications in NSW. From pre-DA consultation and planning report preparation through to lodgement, Council negotiation, post-submission monitoring and Section 4.55 modifications.

Meliora Projects offers a full suite of services for Development Applications in NSW, including pre-DA consultation, planning report preparation, NSW Planning Portal lodgement, Council negotiation, post-submission monitoring and Section 4.55 modifications. Whether you’re preparing a new DA or modifying an existing consent, our work is designed to give you a clear pathway through the assessment process.

Pre-DA Consultation and Planning
Early-stage scoping and Council engagement to position the application for success. Initial Project Scoping: Understanding your project's scope and objectives to ensure we approach the application with a clear, tailored strategy. Site Assessments: Thorough site investigations to identify any constraints and ensure compliance with zoning laws and planning controls. Pre-lodgement Meetings: Liaising with local councils to gain valuable feedback and refine your development proposal before formal submission.
Application Preparation
At Meliora Projects, we specialise in preparing the necessary planning reports to accompany your development application (DA). While clients or project teams provide the required documentation, our role is to produce tailored planning reports that ensure your application aligns with all relevant regulations and requirements.
Submission and Lodgement
If this service is selected, we will take responsibility for submitting your Development Application (DA) with the relevant local council or planning authority. This includes: Final review and quality check of all DA documentation. Formal submission via the NSW Planning Portal or applicable lodgement pathway. Coordination of any final inputs from your project team (e.g. architectural plans, supporting reports). Management of council acknowledgements and submission receipts. Ongoing tracking of your DA progress and response to administrative requests. Handling minor amendments or clarifications requested post-lodgement. Our goal is to ensure your DA is submitted properly, on time, and without unnecessary delays, so it can move into the assessment stage with confidence.
Consultation and Negotiation
Community Consultation: Engagement with local communities, stakeholders, and government agencies to foster support for your project. Council Negotiations: Representing you during council meetings and negotiations, ensuring your application addresses any concerns raised by local authorities.
Post-Submission Monitoring
Ongoing Support: Tracking the DA's progress, responding to requests for additional information, and addressing any concerns raised during the assessment process.
Section 4.55 Modifications
Section 4.55 applications enable formal modification of existing development consents under the Environmental Planning and Assessment Act 1979 (NSW). We support clients through all three modification pathways: Section 4.55(1): Correction of minor errors or misstatements. Section 4.55(1A): Minimal environmental impact, minor changes to approved plans or conditions. Section 4.55(2): More substantial modifications, provided the proposal remains substantially the same development. From simple plan updates through to complex staged changes, condition amendments and design modifications, our planning advice helps you determine the right pathway and prepares the documentation to support your modification request.
04 Steps Process

Our Approach

From project scoping through to determination

A structured four-step process that takes a DA from initial scoping through preparation, lodgement and determination. Managing each stage to reduce uncertainty and resolve issues proactively.

04 Steps Process
01

Scope

Project scoping, site assessment and identification of zoning controls, planning constraints and likely consent pathway. Where useful, we engage Council in pre-lodgement discussions to test the proposal early and refine the application strategy.
02

Prepare

Preparation of planning reports, Statement of Environmental Effects, planning justification, Clause 4.6 variation requests where required, and any other supporting documentation. We coordinate with the broader consultant team to assemble the application package.
03

Lodge

Submission via the NSW Planning Portal, management of Council acknowledgements and tracking through the early assessment stages. We respond to administrative requests and coordinate minor amendments as they arise.
04

Determine

Support through the assessment, responding to Requests for Information, addressing referral comments and managing the path to determination. If conditions are imposed, modifications are needed or a Section 8.2 Review is appropriate, we provide ongoing advice.

NSW DA Process

The DA Assessment Process at a Glance

The Development Application process in NSW is a structured assessment pathway under Part 4 of the Environmental Planning and Assessment Act 1979. Each stage involves specific planning, documentation and Council engagement requirements.

The five key stages:

Pre-Lodgement

Pre-DA
Consultation

Initial scoping, site assessment and pre-lodgement engagement with Council. Identifies zoning constraints, planning issues and Council expectations before significant documentation cost is incurred.

Lodgement

Documentation & Lodgement

Preparation of planning reports, coordination with the consultant team and formal lodgement via the NSW Planning Portal. Includes the Statement of Environmental Effects and supporting documentation.

Council

Council Assessment
& RFIs

Council reviews the documentation and may issue Requests for Information (RFIs). Internal referrals to traffic, stormwater, heritage and other technical teams typically run in parallel.

Community

Community Consultation & Notification

Where required, the proposal is notified to surrounding neighbours and placed on public exhibition. Community feedback may be considered as part of the assessment.

Determination

Determination & Conditions

Council determines the application and (where approved) imposes conditions of consent. If refused, applicants may consider a Section 8.2 Review, a modified DA, or an appeal to the NSW Land and Environment Court.

Realistic timelines: DA assessment timelines vary by Council, application complexity and project type. Pre-lodgement engagement and a well-prepared application package can significantly reduce assessment time and risk.
FAQs

Frequently Asked Questions

Common questions about NSW Development Applications and Section 4.55 modifications.

What is a Development Application (DA)?

A Development Application (DA) is a formal request for consent to carry out a proposed development. It is assessed by the local council or relevant planning authority under NSW planning laws. A DA is typically required for new builds, significant alterations, change of use, subdivisions, or developments that fall outside exempt or complying codes.

How long does the DA process take in NSW?

DA approval can take several months, depending on the complexity of the project and the local council's timeline.

What happens after the DA is submitted?

Once your DA is submitted, the council reviews the documentation and may request additional information. They will also carry out internal referrals (e.g. to traffic, stormwater, heritage teams), and may notify neighbours. We stay involved during this phase to respond to requests and keep the application moving forward (if this service is selected).

What can I do if my DA is refused?

If your Development Application is refused, you may have options such as lodging a Section 8.2 Review, submitting a modified proposal, or appealing to the NSW Land and Environment Court. We can advise on the most suitable course of action based on the reason for refusal.

What if the council requests changes or further information?

It's common for councils to issue Requests for Information (RFIs) during assessment.

What is a Section 4.55 application?

A Section 4.55 application is a formal request to modify an existing development consent under the Environmental Planning and Assessment Act 1979 (NSW). It allows applicants to make changes to a previously approved development, such as updating plans, conditions, or staging without lodging a new DA.

When would I need to lodge a Section 4.55 modification?

You may need a Section 4.55 modification if:

- You want to make design changes to your approved plans
- The project needs to be built in stages or rescheduled
- Certain conditions of consent need to be amended or deleted
- Site constraints require practical changes to the approved development

We assess the scope of changes and advise which type of 4.55 pathway is appropriate or if a new Development application is required instead.

What are the different types of Section 4.55 modifications?

There are three main types of modifications under Section 4.55:

- Section 4.55(1): Correction of minor errors or misstatements
- Section 4.55(1A): Minimal environmental impact, minor changes to approved plans or conditions
- Section 4.55(2): More substantial modifications, provided the proposal remains substantially the same development

We determine the appropriate type based on the nature and extent of the proposed changes.

Can any approved development be modified under Section 4.55?

Not always. The proposed changes must not alter the development to the point where it is no longer substantially the same as the originally approved scheme. If the changes are too significant, a new Development Application may be required.

How is a Section 4.55 application assessed by Council?

The assessment process is similar to a DA, although generally more streamlined. Council considers whether the proposed modifications meet the test of "substantially the same development", and whether the original assessment criteria are still satisfied. Public notification may be required, depending on the type and scale of the changes.
