NSW Approval Pathways at a Glance
NSW offers a graduated approval framework, from minor exempt works through to State-led major developments. Identifying the right pathway early is one of the most valuable outcomes of an advisory engagement. The five pathways most relevant to property and land development projects are:
No approval
Exempt
Development
Minor works that meet specific standards and do not require any approval. Examples include small sheds, fences and decks within prescribed limits. Set by State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.
Fast-track
Complying Development (CDC)
Fast-track approval pathway for projects that meet predetermined development standards. Approved by an accredited certifier rather than Council. Typically faster but with stricter design constraints.
Most common
The most common pathway for residential, commercial, industrial and mixed-use projects. Lodged with Council and assessed against the LEP and DCP. Requires a Statement of Environmental Effects and supporting documentation.
Regional Panel
Larger or higher-impact development determined by a Regional Planning Panel rather than Council. Typically triggered by capital investment value, controversial use, or specific Council ownership thresholds.
LEP Amendment
State Significant Development (SSD)
Major projects determined by the Department of Planning. Subject to SEARs and typically requires an EIS, Social Impact Assessment and detailed engagement strategy.
